In this paper we look at some of the ingredients and processes involved in the understanding of mathematics. We analyze elements of mathematical knowledge, organize them in a coherent way and take note of certain classes of items that share noteworthy roles in understanding. We thus build a conceptual framework in which to talk about mathematical knowledge. We then use this representation to describe the acquisition of understanding. We also report on classroom experience with these ideas.

In this short note, we discuss several aspectsof dimensions and the related constructof factors. We concentrate on those aspectsthat are relevant to articles in this specialissue, especially those dealing with the analysisof the wild animal cases discussed inBerman and Hafner's 1993 ICAIL article. We reviewthe basic ideas about dimensions,as used in HYPO, and point out differences withfactors, as used in subsequent systemslike CATO. Our goal is to correct certainmisconceptions that have arisen over the years.

Legal reasoning is an engaging field for cognitive science, since it raises so many fundamental questions, such as the representation and evolution of complex concepts. This article focuses on aspects of legal reasoning that require reasoning with cases, often in concert with other modes of reasoning.

The BankXX system models the process of perusing and gathering information for argument as a heuristic best-first search for relevant cases, theories, and other domain-specific information. As BankXX searches its heterogeneous and highly interconnected network of domain knowledge, information is incrementally analyzed and amalgamated into a dozen desirable ingredients for argument (called argument pieces), such as citations to cases, applications of legal theories, and references to prototypical factual scenarios. At the conclusion of the search, BankXX outputs the set of argument (...) pieces filled with harvested material relevant to the input problem situation.This research explores the appropriateness of the search paradigm as a framework for harvesting and mining information needed to make legal arguments. In this article, we describe how legal research fits the heuristic search framework and detail how this model is used in BankXX. We describe the BankXX program with emphasis on its representation of legal knowledge and legal argument. We describe the heuristic search mechanism and evaluation functions that drive the program. We give an extended example of the processing of BankXX on the facts of an actual legal case in BankXX's application domain — the good faith question of Chapter 13 personal bankruptcy law. We discuss closely related research on legal knowledge representation and retrieval and the use of search for case retrieval or tasks related to argument creation. Finally we review what we believe are the contributions of this research to the understanding of the diverse disciplines it addresses. (shrink)

In this article we evaluate the BankXX program from several perspectives. BankXX is a case-based legal argument program that retrieves cases and other legal knowledge pertinent to a legal argument through a combination of heuristic search and knowledge-based indexing. The program is described in detail in a companion article in Artificial Intelligence and Law 4: 1--71, 1996. Three perspectives are used to evaluate BankXX:(1) classical information retrieval measures of precision and recall applied against a hand-coded baseline; (2) knowledge-representation and case-based (...) reasoning, where the baseline is provided by the functionality of a well-known case-based argument program, HYPO (Ashley, 1990); and (3) search, in which the performance of BankXX run with various parameter settings, for instance, resource limits, is compared. In this article we report on an extensive series of experiments performed to evaluate the program. We also describe two additional experiments concerning(1) the program's search behavior; and (2) the use of a modified form of precision and recall based on case similarity. Finally we offer some general conclusions that might be drawn from these particular experiments. (shrink)

We discuss several aspects of legal arguments, primarily arguments about the meaning of statutes. First, we discuss how the requirements of argument guide the specification and selection of supporting cases and how an existing case base influences argument formation. Second, we present,our evolving taxonomy of patterns of actual legal argument. This taxonomy builds upon our much earlier work on argument moves and also on our more recent analysis of how cases are used to support arguments for the interpretation of legal (...) statutes. Third, we show how the theory of argument used by CABARET, a hybrid case-based/rule-based reasoner, can support many of the argument patterns in our taxonomy. (shrink)

This game3 was designed to investigate protocols and strategies for resourcebounded disputation. The rules presented here correspond very closely to the problem of controlling search in an actual program. The computer program on which the game is based is LMNOP. It is a LISP system designed to produce arguments and counterarguments from a set of statutory rules and a corpus of precedents, and applied to legal and quasi-legal reasoning. LMNOP was co-designed by a researcher in AI knowledge representation and by (...) a trained computer scientist who was an editor of Washington University Law Review at the time. LMNOP is based on the idea of a non-demonstrative or defeasible rule: i.e., a rule that admits exceptions. It adopts a representational convention that supposes there is an implicit preference of more specific rules over less specific rules. In fact, it automatically adjudicates between competing arguments when one argument meets the broader criterion of being more specific than another. The convention is based on an idea origianlly presented by David Poole [85], and is embedded in a system of determining which arguments are ultimately warranted, which originally appeared in the literatures of epistemology and ethics, by Pollock [87]. This system evolves from work by the first author since 1987; the full statement of the theory is in [92]. Prakken [92] is one example of the idea’s application to the legal domain. LMNOP also draws heavily on the model of legal reasoning and analogical reasoning put forward by Edwina Rissland and Kevin Ashley [89, 90]. Similarities to their legal casebased reasoning program, HYPO, are no accident; LMNOP seeks to improve on HYPO. A description of LMNOP is forthcoming. (shrink)

Cyprian’s appropriation of Scripture and his theological emphases are closely connected with the circumstances of his congregation. As a case study in Cyprian’s biblical interpretation, this article considers all his quotations of and allusions to Philippians through the lens of his pastoral concerns: the unity of the Church; care for the poor and captive; discipline and repentance; and divine truth and eternal glory. The reading strategies Cyprian uses can be categorized as contextual exegesis, model, image, direct application, and prophetic fulfilment. (...) The study provides a fresh perspective on patronage and almsgiving in Cyprian, deepens our understanding of the reception of Paul, and elucidates the interplay of text, context and theology in an important exponent of early Latin exegesis. Justifying involuntary psychiatric treatment on the basis of a judgment that a person lacks capacity is usually expressed in terms of a person’s ability to make a decision about his or her health and treatment. Typically, this relates to the ability to refuse treatment. This paper sets up a thought-experiment that examines the transformation of energy into codified mass. This transformation is understood as a semiosic action of interpretation. The semiosic action is analyzed within five “predicate” or “verbal modes” which establish different processes of transformation or interpretation. These “predicate modes”, which are sign processes, take place in different areas of reality, the external realm and the internal realm. The external realm is composed of discrete objects and their interactions. Its processes are examined within (...) classical mechanics and this paper posits a semiosic codification that is unique to these external processes. The internal realm is a holistic endoperspective with no recognition of discrete objects. Its processes are examined within quantum and field processes and this paper posits a semiosic codification that is unique to the internal processes. However, rather than promoting one or the other realm as a valid interpretation of reality, this paper suggests that both the external and internal energy-mass processes are necessary components of our universe. Health justice is an aspirational north star for scholars, practitioners, and anyone who refuses to accept the status quo of profound inequity. But what does health justice mean? How ought we conceptualize it? There is no correct answer to these questions, but any robust rendering of health justice must account for power and politics. This article posits that the path to health justice requires political struggle taking (at least) two forms: (1) building power and (2) breaking power. Building power for (...) health justice means cultivating the political capacity of people who are disproportionately harmed by health inequity, and who therefore have the most at stake. Breaking power involves weakening and destabilizing the economic and political forces that perpetuate health inequity. By surfacing and elaborating these crucial modes of political struggle, this article points to a way forward for achieving health justice. (shrink)

This article reports a comparative test of the central-union theory vis-à-vis several other game-theoretic solution concepts in 3-person sidepayment games. Based on a laboratory experiment, this comparison utilizes nine games in characteristic function form. The solution concepts under test include the equal excess model, the Myerson–Shapley solution, the kernel, and two variants of the central-union theory. With regard to the player's payoffs, results show that the CU-1, CU-2, kernel, and equal excess theories have essentially equal predictive accuracy and that all (...) of these are more accurate than Myerson–Shapley. When the solution concepts are extended and coalition structure probability predictions are incorporated in the test, one version of the central-union theory is overall more accurate than the other solutions. Purpose This study aims to explore how health informatics can underpin the successful delivery of recovery-orientated healthcare, in rural and remote regions, to achieve better mental health outcomes. Recovery is an extremely social process that involves being with others and reconnecting with the world. Design/methodology/approach An interpretivist study involving 27 clinicians and 13 clients sought to determine how future expenditure on ehealth could improve mental health treatment and service provision in the western Murray Darling Basin of New South Wales, Australia. (...) Findings Through the use of targeted ehealth strategies, it is possible to increase both the accessibility of information and the quality of service provision. In small communities, the challenges of distance, access to healthcare and the ease of isolating oneself are best overcome through a combination of technology and communal social responsibility. Technology supplements but cannot completely replace face-to-face interaction in the mental health recovery process. Originality/value The recovery model provides a conceptual framework for health informatics in rural and remote regions that is socially responsible. Service providers can affect better recovery for clients through infrastructure that enables timely and responsive remote access whilst driving between appointments. This could include interactive referral services, telehealth access to specialist clinicians, GPS for locating clients in remote areas and mobile coverage for counselling sessions in “real time”. Thus, the technology not only provides better connections but also adds to the responsiveness of any treatment available. (shrink)
